Deal or No Deal Board Game, New Zealand Competition 

General:

1. Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms
and Conditions.

Eligibility:

2. Entry is only open to NZ citizens and permanent residents aged 18 years or older.

Employee Exclusion:

3. Employees (and their immediate families) of the Promoter and companies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild, parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

Promotional Period:

4. Promotion commences 9:00am on October 21, 2024, NZST and closes at 3:59pm on June 30, 2025.

Promotion Entry:

5. To be eligible to enter, entrants must purchase during the promotional period, the “Deal or No Deal – Win a Million Edition” board game from participating outlets, subject to stock availability. Inside each board game is an entry ticket with a unique entry code printed on it (“Code”). A ‘participating retailer’ is any authorised retailer that stocks the “Deal or No Deal” board game, as listed at www.milliondollardeal.co.nz

6. To enter, eligible entrants must, during the Promotional Period.

a. visit www.milliondollardeal.co.nz; and

b. complete the promotional entry form with all requested details, and the unique Code; and

c. submit the fully completed entry form.

Prize Draw:

7. The draw will take place at Incentive Solutions 6/101 Diana Drive Wairau Valley Auckland 0627 on June 30, 2025. The first valid entry (‘Eligible Entrant’) drawn by an independent adjudicator will have the chance to win $1,000,000 in cash by playing the Game (details below).

Eligible Entrant and ‘the Game’ Event Details:

8. The first valid entry drawn will win that Eligible Entrant
(the “Participant“) the opportunity to play a contingency game (the “Game“) for the chance to win $1,000,000.

The Eligible Entrant will be called after the draw and informed of the details of the Game event to take place
on July 7, 2025.

9. The total prize pool value is NZD$1,002,000

• There will be one chance to win the major prize of $1,000,000. The draw will take place at Incentive Solutions 6/101 Diana Drive Wairau Valley Auckland
0627 on June 30, 2025. 

• Plus 20 minor prizes drawn at the same time will win
a $100 The Warehouse gift card.

• The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. 

• The Eligible Entrant will be notified by telephone and/or video call. The Eligible Entrant will be published on the entry page within five (5) business days of the draw. 

• If for any reason an Eligible Entrant or minor prize winner fails to claim their prize (either by not participating in the game, or not being contactable to accept the prize outcome of the game as conducted by a representative of the promoter) by the July 5 2024, the prize will be forfeited by that Eligible Entrant and the Promoter reserves the right to re-allocate the prize to the first reserve entrant (or subsequent reserve entrants if necessary to confirm
a recipient).

• The Game will take place at Incentive Solutions 6/101 Diana Drive Wairau Valley Auckland 0627 on July 7, 2025.

• All costs associated with attending the Game are the sole responsibility of the Eligible Entrant (now ‘Participant’). If the Participant cannot attend the game in person, the Participant may participate in the Game via telephone or a video call whereby they will select a number between 1 and 250 (inclusive) and a representative of the Promoter will take a written record of that number on their behalf. If the drawn Participant cannot attend the Game, the Participant may appoint a proxy over 18 years of age to play the Game on his/her behalf provided the Participant gives the Promoter written, signed notice to that effect before the start of the Game. 

• There will be one tamper proof envelope prepared by the Insurance Representative on display at the start of the Game. The Participant/representative (“Attendee”) must provide the Promoter with a single number between 1 and 250 that will be written down by the Promoter (the “Attendee’s Chosen Number”). The Promoter will then open the envelope.  If the Attendee’s Chosen number,  subject to verification by the judges, matches the number in the envelope the  Participant will win the Major Prize of NZ$1,000,000.  Funds will be paid via EFT into the nominated bank account within 28 Days. 

• If the Attendee’s Chosen envelope is not the Major Prize it will not be given away and, subject to verification by the judges, the drawn Participant will win the conciliatory prize of a NZ$5,000 prize awarded in the form of a The Warehouse gift card.

• The drawn Participant’s odds of winning the $1,000,000 prize are 1 in 250. The odds of being drawn as a Participant may be significantly higher than the odds of the drawn Participant winning the major prize and will depend upon the number of entries received.

• Winners are responsible for ensuring and checking the accuracy of the bank details provided and the Promoter is not responsible for any errors that are a result of the winners providing the incorrect details. The Promoter will not be responsible for banking institutions rejecting an EFT payment, or any costs associated with locating any lost prizes. Not providing bank details by the date requested by Promoter may result in prize payments being delayed. The Promoter is not responsible for any payments that have been successfully transferred into an incorrect nominated bank account. In these cases, there will be no further payments made.

• The Game will be supervised by a representative from Anisimoff Legal (as they are approved by the Insurance underwriters) Suite 626 100 Walker Street North Sydney NSW 2000 via Teams Video.

• The Promoter’s decision is final, and no correspondence will be entered into.

10. Prizes are not transferable or exchangeable.

Resale Prohibition:

11. The “Deal or No Deal” board game must not be resold or offered for resale at a premium (including via online auction sites). If a board game is sold in breach of this condition, the Promoter may withdraw the corresponding entry ticket from this promotion, making the purchaser ineligible to win the Prize.

Multiple Entries:

12. Entrants may enter the promotion multiple times during the Promotion Period, provided that each entry code submitted is unique. The promoter reserves the right to issue bonus codes for the promotion for promotional purposes as they see appropriate.

Proof of Purchase Requirement:

13. Entrants must retain their original code and a copy of their purchase receipt or gift receipt as proof of purchase. Failure to produce the proof of purchase for an entry when requested may result in invalidation of an entrant’s entry and forfeiture of any right to a prize.

Prize Claim:

14. In the event the drawn winner fails to claim the prize by the specified date, the reserve entries will be used. Winners will be notified by telephone and in writing via email within two business days of the draw, and their names will be published on www.milliondollardeal.co.nz

Travel for Promotion:

15. The winner may be asked by the Promoter to travel for the Million Dollar Deal event for the promotion of this competition. At the promoter’s discretion, travel expenses may be covered by the Promoter.

Decision Finality:

16. The Promoter’s decision is final, and no correspondence will be entered into.

Website Access Costs:

17. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent
on the Internet service provider used.

Consent for Use of Information:

18. Entrants consent to the Promoter using their name, likeness, image, and/or voice in the event they are a winner (including photograph, film, and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), “Deal or No Deal” generally, and promoting any products manufactured, distributed, and/or supplied by the Promoter.

Promotion Interference:

19. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter including but not limited to technical difficulties, unauthorised intervention, or fraud, the Promoter reserves the right, in their discretion, to the fullest extent permitted by law, (a) to disqualify any entrant; or (b) to modify, suspend, terminate, or cancel the promotion, as appropriate, subject to any directions from a regulatory authority.

Liability and Guarantees:

20. Nothing in these Terms and Conditions limits, excludes, or modifies or purports to limit, exclude, or modify the statutory consumer guarantees as provided under the Consumer Guarantees Act 1993(“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective officers, employees, and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Responsibility for Loss:

21. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective officers, employees, and agents), and Endemol Shine Australia (ESA) are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third-party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions;
(e) any tax liability incurred by a winner or entrant;
or (f) use of the prize.

Collection of Personal Information:

24. Entrants’ personal information will be collected by the Promoter and stored on the Promoter’s database. The Promoter may use this information for future marketing purposes and its promotional partners regarding its products, including contacting the entrant electronically.

25. The Promoter is bound by the Privacy Principles in accordance with the Privacy Act 2020 and its privacy policy, which can be viewed at www.milliondollardeal.co.nz. Entrants may also opt-in to receive updates from their partners. By opting in, entrants agree that their information will be collected and handled by the promoter and will be subject to the promoter’s privacy policy, which can be viewed at www.milliondollardeal.co.nz.
